An errors and omissions (E&O) policy is a type of professional liability insurance for a notary public. E&O insurance protects notaries from financial loss if they are accused of committing a negligent act while offering notarial services.

Notarization mistakes that result in a client losing money can be grounds for a lawsuit. That's why most policies cover expenses related to judgments, attorney fees, court costs and settlements up to the policy's dollar limit.

Tips for Completing an Error-Free Application

  1. If the application has three or more blank spaces, the Department of the Secretary of State will deny it, and you will have to submit a new application and pay an additional fee.
  2. After completing the mandatory notary education course, submit your application to the instructor for their signature. Do not add your own signature until you are in the presence of an active NC notary.
  3. Get your application notarized in-person and sign it in front of the commissioned notary. Notaries must remain impartial and cannot notarize documents in which they have a personal interest. Therefore, you cannot notarize your own application. Doing so will result in automatic disqualification.
