A criminal background check is one of California's most important steps for becoming a notary public. The Secretary of State (SOS) uses these checks to help ensure applicants meet the qualifications to hold the position.
All applicants are legally required to be fingerprinted during the background check process using the California Department of Justice’s (DOJ) Live Scan Program. This article describes the Live Scan service and how to submit your fingerprints.
After the state notifies you that you passed the notary exam, it’s time to start the background investigation. You must have your fingerprints taken within one year of the exam date. If you fail to do so, you’ll need to retake the exam. You will not receive your notary commission until your background check comes back stating that there is either no criminal history or your criminal history is non-disqualifying.
The DOJ accepts fingerprints using an electronic system called the Live Scan Program. The system takes and transmits fingerprints to the DOJ and the Federal Bureau of Investigation (FBI). Your fingerprint images are automatically searched against all other images in the fingerprint database.
To submit your set of classifiable fingerprints for each commission term, you must do the following:
The SOS recommends requesting a copy of your Request for Live Scan Service form. Keep it until you receive your notary commission.
If no prints in the database match yours, the transaction is generally processed within 48 to 72 hours.
If your fingerprints match, a technician must manually review your associated record of arrests and prosecutions (RAP) sheet to determine whether your criminal history is non-disqualifying. This process can take an indeterminate amount of time.
If further review is needed, you’ll receive a delay notice response. Questions or status inquiries related to a delayed transaction cannot be answered. You can just keep an eye on the background check status and wait for further communication.
The background check includes name check processing in addition to your fingerprint check. According to the SOS, the name check can take up to four weeks. That’s why we recommend giving yourself plenty of time to complete this process, especially if you’re renewing your commission!
